This Privacy Policy explains how Protly, LLC, a Delaware limited liability company ("Protly," "we," "us," or "our"), collects, uses, discloses, stores, and protects information about you when you use the Protly mobile application, website, and related services (collectively, the "Service").

If you do not agree with this Privacy Policy, do not use the Service. By creating an account, uploading content, or otherwise using the Service, you acknowledge the practices described below.

1. What This Policy Covers

This Privacy Policy covers information we collect directly from you, automatically from your device or browser, from service providers acting on our behalf, and from app-store, payment, or authentication partners involved in operating the Service.

The Service is operated from the United States and is intended for users in the United States.

2. Information We Collect

We collect the following categories of information:

2.1 Account and Contact Information

  • Name, username, and email address
  • Login credentials and authentication identifiers
  • Optional profile details you choose to provide

2.2 Nutrition, Wellness, and User Content

Because the Service is designed to help you log meals and track protein intake, you may choose to provide sensitive information, including:

  • Meal logs, protein intake, and nutrition entries
  • Dietary preferences, exclusions, goals, routines, and notes
  • Photos of meals, food packaging, or related content you upload
  • Other wellness or lifestyle information you decide to enter
  • Profile and onboarding details such as age or date of birth, sex, height, weight, activity level, and related goal-setting data

Do not submit information you are not comfortable storing in a commercial app. If you choose to enter sensitive information, you consent to our handling of it as described in this Privacy Policy.

2.3 Subscription and Transaction Information

  • Subscription status, plan type, renewal dates, and receipts
  • Transaction identifiers supplied by app-store or payment partners
  • Limited billing-related records needed for support, fraud prevention, accounting, and compliance

We do not intentionally store full payment card numbers when purchases are processed by third-party platforms.

2.4 Device, Usage, and Diagnostic Information

  • Device type, operating system, browser, app version, and language
  • IP address, approximate location derived from IP, and time zone
  • Device identifiers, app instance identifiers, push-notification tokens, and similar technical identifiers
  • Feature usage, interactions, session activity, and referral data
  • Crash logs, performance metrics, and debugging information

2.5 App Permissions and Device Features

  • Camera access for food scanning, barcode scanning, and meal capture
  • Photo-library access for selecting food images
  • Notification permissions and reminder settings, including push and scheduled notifications where supported
  • Device features such as time zone, widgets, and other supported tools used for food or portion analysis

2.6 Support and Communications

  • Email correspondence with support
  • Feedback, bug reports, and survey responses
  • Records of privacy, deletion, or account-related requests

3. Sources of Information

We collect information from the following sources:

  • Directly from you when you register, log meals, upload content, pay, or contact us
  • Automatically from your device, browser, or app usage
  • From third-party sign-in, payment, messaging, analytics, nutrition, or infrastructure providers that support the Service
  • From service providers that support hosting, analytics, authentication, customer support, and payments
  • From app stores or platform partners when they confirm a purchase, subscription, or entitlement

4. How We Use Information

We use your information to:

  • Provide, operate, maintain, and improve the Service
  • Create and manage your account and subscriptions
  • Support meal logging, nutrition tracking, and related features
  • Send reminders, service messages, and support communications
  • Monitor performance, prevent misuse, and comply with legal obligations

5. Sensitive Data and Health-Related Information

Nutrition logs, food photos, dietary goals, and similar entries may be considered sensitive under certain laws. You are not required to provide more information than you want, but core features of the Service depend on the information you choose to enter.

We use this information to operate the Service you requested. We do not treat the Service as a hospital, physician, insurer, or emergency service, and you should not use the Service to seek diagnosis, treatment, or urgent care.

We may also use information you provide, as well as de-identified, aggregated, or otherwise processed data derived from it, to improve the Service and related systems.

6. Third-Party Services, Sign-In, and Billing

We use third-party services to help operate the Service, including for hosting, authentication, messaging, analytics, nutrition or food recognition, subscription management, payments, customer support, and related infrastructure.

Some information may be processed by third-party providers as part of operating the Service. We may receive account identifiers, purchase confirmations, subscription status, or other information needed to provide and support the Service.

Third-party services, platforms, and websites integrated with or linked from the Service may have their own terms, conditions, and privacy practices. As a result, your use of certain parts of the Service may also be subject to those terms and practices. We are not responsible for practices we do not control.

7. When We Share Information

We do not sell your personal information for money.

We may disclose information in the following categories of situations:

  • Service providers that host, secure, analyze, authenticate, support, or maintain the Service
  • Payment processors, app stores, and subscription partners involved in billing or entitlement management
  • Professional advisers, auditors, insurers, or acquirers involved in financing, diligence, or corporate transactions
  • Government authorities, regulators, courts, or law enforcement when we believe disclosure is required or appropriate
  • Other parties when necessary to detect fraud, stop abuse, enforce our terms, or protect rights, property, safety, or security
  • Recipients of aggregated or de-identified information that does not reasonably identify you

We may transfer information as part of a merger, acquisition, reorganization, bankruptcy, financing, or sale of some or all assets.

8. Local Device Storage

Some information may be stored locally on your device, including in app storage, cached files, widgets, or similar features. This local data may remain until it is deleted, overwritten, or cleared by you, the app, or your device.

9. Data Retention

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Service, maintain business records, resolve disputes, enforce our agreements, and comply with law.

  • Account, nutrition, and user-content data generally remain until you delete them or close your account
  • Operational logs, diagnostics, and security records may be kept for shorter or longer periods based on business and security needs
  • Backups may persist for up to 30 days before routine overwriting or purging
  • Certain records may be kept longer if required for tax, accounting, fraud, legal hold, dispute, or regulatory reasons

Deletion from active systems does not always mean immediate removal from every backup or residual archive.

10. Security

We use administrative, technical, and physical safeguards designed to protect information from unauthorized access, loss, misuse, or alteration. No system is perfectly secure, and we do not guarantee that the Service will be immune from every attack, intrusion, or failure.

You are responsible for maintaining the confidentiality of your account credentials and for using the Service on devices and networks you trust.

11. Cookies, Similar Technologies, and Website Activity

Our website and related online services may use cookies, pixels, local storage, session tools, or similar technologies to keep the site functioning, remember preferences, understand traffic and usage patterns, measure performance, and improve the Service.

You can usually control cookies through your browser settings, but disabling certain technologies may affect site functionality.

12. Your Privacy Choices and Rights

You may be able to:

  • Access, correct, or delete certain account information in the app
  • Request a copy of certain personal information we hold about you
  • Request deletion of your account and associated personal information, subject to legal exceptions
  • Ask us to explain how we process your personal information

To make a privacy request, contact support@protly.app. We may ask you to verify your identity before acting on a request. Authorized agents may be required to provide proof of authority and we may still ask you to verify your identity directly.

We will not discriminate against you for exercising rights granted by applicable privacy law.

12.1 California Notice

In the preceding 12 months, we may have collected the following categories of personal information: identifiers, account credentials, commercial or subscription information, internet or network activity, device information, geolocation derived from IP, user-generated content, support communications, and sensitive information such as nutrition and wellness entries that you choose to provide.

We collect those categories from you, your device or browser, app-store and payment partners, and service providers acting on our behalf. We use them for the business and commercial purposes described in this Privacy Policy and may disclose them to the categories of recipients described in Section 6.

13. Children's Privacy

The Service is not intended for children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information to us, contact us and we will investigate and, if appropriate, delete the information.

14. United States Operation

The Service is intended for users in the United States. If you access the Service from outside the United States, you understand that your information may be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your jurisdiction.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we may provide notice through the Service, by email, or by another reasonable method. The "Last Updated" date above shows when this version became effective.
